"Originally I used a duty solicitor who actually sabotaged my case and then cried conflict of interest when the going got tough, proved to be a blessing in disguise for me because I do not think they would have done well for me in court. Mr Campbell took over my representation and after losing all confidence leading up to my trial with the previous firm he gave me a massive boost as I now feel personally that I had someone who was going to fight my corner and he done just that! I got the best possible result I could have hoped for and I'm free to continue with my life without a criminal conviction all thanks to him so yes I would definitely use again and highly recommend!."

Criminal Defence Fees

Our fees are determined on an hourly rate of £175 (plus VAT) per hour, with routine letters and telephone calls charged at 1/10th of that rate. We will always provide a costs estimate and agree it with you before commencing work on your behalf, indicating the amount of work needed and the basis of the fee calculation. If we need to incur any disbursements, we will always seek to identify these in advance and obtain your approval before incurring them.

Depending on the nature of your case, we may agree a fixed-fee quote calculated based upon our hourly rate, identifying what the fixed fee does and does not include. By way of example, our standard fixed fee for a matter that can be dealt with in one hearing before Carlisle Magistrates’ Court is £375 plus VAT (£75), whereas for a Crown Court trial the cost depends on the length of the trial but would likely be calculated at £500 plus VAT per day. This would include:

  • An initial conference (in our office or by telephone/email, to your preference).
  • Consideration of the case papers.
  • Legal advice on your case and the court procedure.
  • Further investigation and preparatory work.
  • Attending court with you for the hearing, with a case length up to one half day.
  • Post-hearing advice and confirmation of outcome.

Criminal Defence FAQs

A criminal defence solicitor in England plays a crucial role in the legal system, offering specialised guidance and representation to individuals accused of crimes. Their primary duty is to ensure that the rights of the accused are protected throughout the legal process.

This involves offering expert legal advice, devising a strong defence strategy, and representing the client in police interviews and court proceedings. They analyse the case details, gather evidence, and work closely with clients to prepare for trial, negotiating with prosecutors to secure the best possible outcome – which could range from reduced charges to, in some instances, the dismissal of charges.

They also clarify complex legal jargon and procedures so their clients are well-informed and prepared.

An example of a criminal offence in England is burglary. Burglary involves entering a property with the intent to commit an offence, such as theft, infliction of grievous bodily harm, or unlawful damage to the property. This crime is considered serious due to its invasive nature and the potential harm and distress it causes to victims.

The legal system categorises burglary under offences against property, and it carries significant penalties, including imprisonment, fines, and community orders, depending on the severity of the offence and the circumstances surrounding the crime.

Yes, criminal defence solicitors in England frequently go to court to represent their clients. Their representation can occur in various settings, including Magistrates’ Courts, Crown Courts, and, in some instances, higher courts, depending on the seriousness of the offence and the specifics of the case.

They advocate on behalf of their clients, presenting evidence, questioning witnesses, and making legal arguments to support the defence. Their involvement is critical in ensuring the accused receives a fair trial and that their legal rights are upheld throughout the court proceedings.

In England, the majority of criminal cases commence in the Magistrates’ Court. This is the first tier of the criminal justice system, where less serious offences, known as ‘summary offences’ (such as minor theft or public disorder), are handled.

However, more serious offences – ‘either-way offences’ (which could be tried in either court) and ‘indictable offences’ (such as robbery, serious assaults, or murder, which must be tried in the Crown Court) – also start in the Magistrates’ Court for preliminary hearings before being transferred to the Crown Court for trial or sentencing.

So while not all cases are concluded in the Magistrates’ Court, this is where they initially enter the judicial system.

In the context of English law, the terms ‘offence’ and ‘crime’ are often used interchangeably to refer to acts that violate the law. An offence refers to a breach of a specific law or regulation, resulting in legal action against the individual who committed the act.

A crime is a broader term that encompasses all types of offences, ranging from petty crimes to more serious indictable offences. Therefore, all crimes are offences, but the terminology used can vary depending on the legal context and the severity of the act committed.
