VOSA Offences for Business Fees

Our fees are determined on an Hourly rate of £250 (plus VAT) per hour with routine letters and telephone calls charged at 1/10th of that rate. This is the basis of how we calculate our fees. We will always provide a costs estimate and agree it with you before commencing work on your behalf. This will indicate the amount of work needed and the basis of the fee calculation.

In addition if we need to incur any disbursements to complete the work required for you we will always seek to identify these in advance and obtain your approval before incurring them. Depending on the nature of your case, we may agree with you a fixed fee quote calculated based upon our hourly rate. We will identify what the fixed fee does and does not include.

VOSA Offences for Business FAQs

VOSA (now part of the DVSA) can impose fines for a variety of regulatory non-compliances related to vehicle safety, roadworthiness, and transport legislation. This includes, but is not limited to:

  • Overloading vehicles beyond their permitted weight limits.
  • Breaching drivers’ hours regulations by exceeding the maximum driving time or not taking the required rest breaks.
  • Failing to maintain vehicles in a roadworthy condition, including defects in brakes, tyres, and lights.
  • Not adhering to vehicle testing and inspection requirements.
  • Operating without the necessary operator’s licence or breaching the terms of the licence.
  • During inspections, VOSA officials check for compliance with a range of safety and regulatory standards:

Vehicle condition, focusing on safety-critical elements like brakes, tyres, and lights.

  • Compliance with drivers’ hours and tachograph regulations.
  • Load security and vehicle weight to ensure they are within legal limits.
  • Vehicle and operator licensing documentation.
  • Adherence to environmental standards, including emissions levels.

VOSA officers, now operating under the DVSA, have significant enforcement powers, including:

  • Stopping vehicles for checks without prior notice.
  • Issuing fixed penalty notices or fines for certain offences.
  • Prohibiting the movement of vehicles found to be in a dangerous condition until rectified.
  • Instigating legal proceedings for serious breaches of transport regulations.
  • Accessing business premises to inspect records and ensure compliance with the law.

VOSA itself does not enforce speeding regulations; this is typically the remit of the police. However, VOSA can report suspected offences, including speeding, to the police if they are observed during the course of their duties.

If VOSA pulls you over, they will conduct a check of your vehicle and/or documentation to ensure compliance with transport regulations. This can include:

  • Inspecting the vehicle for roadworthiness.
  • Checking drivers’ hours through tachograph data.
  • Verifying load security and weight compliance.
  • Examining your operator’s licence and related documentation.

Depending on their findings, they may issue fines, prohibitions, or warnings, or in serious cases, refer the matter for prosecution.

Yes, VOSA (now DVSA) can prosecute individuals and companies for serious breaches of transport laws. This includes offences related to vehicle safety, drivers’ hours, and operator licensing. Prosecutions can result in fines, penalties, or even imprisonment for the most severe violations.

VOSA (now part of DVSA) officers can check tachograph records up to the last 28 days directly from the vehicle during a roadside check. However, when inspecting an operator’s premises, they can demand records going back up to a year for drivers’ hours and up to two years for other records like maintenance and safety inspections.
